In all provisions of the FTZ and its annexes, in which the Employer refers to standards, approvals, technical specifications or reference systems in accordance with Art. 4 of the Act, the Employer allows equivalent solutions. Where the detailed description of the subject-matter of the contract (Annex 4 to the FTZ) indicates the names of materials, products or equipment of specific manufacturers, this should be considered only as a specification of the desired standard and quality. In all such situations, the Contractor may offer equivalent materials, products or equipment with at least the same parameters. Product equivalence is understood as offering a product whose technical characteristics of the materials used are at least the same as the products described in the FTZ. If an equivalent solution is offered, the Contractor must demonstrate the equivalence of the solutions used. 6. The contractor who relies on equivalent solutions must prove/demonstrate in the tender that the solutions proposed meet the requirements set out in the description of the subject-matter of the contract to an equivalent extent. At the stage of implementation of the works, the contractor will use the materials indicated in the tender, prepared on the basis of the documents listed in paragraph. 2. 7. Before proceeding with the works, the Contractor shall present to the Ordering Party for acceptance specimens of materials used for the execution of the contract, including material cards of all built-in elements, in accordance with the provisions of §6 sec. 6 of Annex 3 to the FTZ – model contract. 8. The contracting authority requires a local vision of the place of performance of the subject of the contract.
