… of the subject-matter of the contract. 3.4. Installation of new cranes with accessories in place of dismantled ones, 3.5. Carrying out the necessary construction, installation and electrical works related to the installation of the device, 3.6. Start-up, testing and technical acceptance. 3.7. Obtaining a UDT decision on placing in service. 3.8. Provide full as-built documentation, instructions for use and staff training. 4. The requirements given by the Ordering Party in these proceedings constitute minimum requirements and should be met mandatorily. Failure to comply with the above (minimum) requirements will result in the rejection of the offer pursuant to Art. 1 point 5 of the PPL Act - its content is inconsistent with the terms of the contract. 5. If in the description of the subject of the contract in these proceedings there are any trademarks, patents or origin, sources or specific processes that characterize the products or services provided by a particular contractor, the Contracting Authority allows equivalent solutions. When preparing the description of the subject of the contract, the Ordering Party did not find any trademarks, patents or origins, sources or specific processes that characterize the products or services provided by a specific Contractor. However, if the Contractor finds / notices, by analysing the description of the subject of the contract, that there are such cases or indirectly indicating one specific product, the Contractor is asked to signal to the Contracting Authority in the form of a query and indicate such products. Then, as an explanation/change of the content of the inquiry, the Ordering Party will specify what features of the ordered product have an equivalent value for him, which will be taken into account in the assessment. A similar rule applies in cases where references to standards, European technical assessments, approvals, technical specifications and technical reference systems have been introduced in the description of the subject-matter of the contract. Offering solutions equivalent to those indicated in the description of the subject of the contract additionally requires demonstrating that the offered equivalent solution is of technical, operational and utility parameters not inferior to those required by the Ordering Party. The burden of demonstrating compliance with these requirements lies with the Contractor in the tender submitted. The Contractor who invokes equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the Ordering Party. In such a case, the Contractor shall attach to the tender a list of equivalent solutions, together with its description or standards. With regard to the standards referred to in the documentation, the contracting authority states that the required standard constitutes a requirement ‘at least’ and allows the subject-matter of the contract to have higher standards equivalent to the one described. The Contractor shall be responsible for quality, compliance with the technical and quality conditions described for the subject-matter of the contract. Due diligence is required in the performance of obligations under a public procurement contract. 6.
