… while the Ordering Party allows the submission of equivalent offers in terms of the description of the subject of the contract. 5) The subject-matter of the contract is determined by indicating objective technical and qualitative characteristics and standards for the determination of which it is permissible to indicate exemplary trademarks. 6) If the Ordering Party refers in the description of the subject of the contract to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the PPL Act, solutions equivalent to those described are allowed. 7) The Ordering Party requires that the subject of the contract be brand new, free from technical and legal defects, of good quality, allowed to be marketed, packed in the original packaging for a given product, provided with labels identifying a given product, specifying its technical, quality, functional and functional parameters. The subject of the contract, as well as the packaging, must bear a trademark and an indication of origin (manufacturer). 8) The Ordering Party does not allow the possibility of submitting partial tenders.
