… d) Training of employees: 1) Conducting training for operating personnel in the field of safe operation of aggregates, start-up procedures, refuelling, fuel level control, failure response and basic service activities. e) The Contractor is obliged to perform the subject of the contract in accordance with: 1) in accordance with the obligations set out in this Agreement, 3. A detailed description of the subject-matter of the contract is contained in Annex No 2 – a description of the subject-matter of the contract, which forms an integral part of this FTZ. 4. The requirements (technical and usage parameters) set out in Annex No. 2 concerning the subject of the contract are minimum requirements. The contracting authority allows the subject-matter of the contract to be offered with better parameters, which should be described in Appendix No. 2a – technical specifications offered to . 5. The Contractor undertakes to perform the subject of the contract correctly, in accordance with the requirements set out in the FTZ and the provisions of the draft contract and the principles of technical knowledge, due diligence and applicable standards and regulations. 6. The Contractor is obliged to notify the Ordering Party about the delivery date at least 2 days in advance. Delivery of the subject of the contract will take place between 8.00-14.00 or after agreement with the Ordering Party at other hours. 7. The Contractor undertakes to supply equipment that is brand new and conforms to the required standards set out in the relevant legislation, manufactured not earlier than 2026, equipped with all components ensuring proper installation and use (e.g. power cords, etc.), unused, free from physical and legal defects, and to issue documentation regarding the delivered subject of the contract, i.e. a register of equipment with serial numbers, certificates, declarations of conformity, catalogue sheets. 8. The contractor will provide hardware and software whose parameters will be consistent (or higher) with the description of the subject of the contract forming an integral part of the contract. 9. CPV number relating to the subject-matter of the contract: 31122000-7 Generator Units 31682530-4 Emergency Power Equipment 10. The Contractor is obliged to provide a minimum guarantee and warranty for a period of 24 months from the date of final receipt of the subject of the contract. 9. The contractor as a waste producer within the meaning of Article 3(3). 32 of the Waste Act is obliged to manage (export and disposal) at its own expense the waste generated during the performance of the task, in accordance with the applicable regulations. 10. Use of materials, equivalent devices: If the manufacturer’s names, proper names, trademarks, patents or the origin of the materials or equipment used to make the supplies which are the subject of the contract are indicated anywhere in the FTZ, this should be treated as an example setting out standards, appearance and technical requirements – and the Contracting Authority allows the use of equivalent materials and equipment in accordance with Article 99(6) of the PPL.
