The subject-matter of the contract shall include in particular: a) preparation of design documentation for the modernization and reconstruction of street lighting in the following streets: Siedzikówna ‘Inki’, Andrychowska, Długosz, Wawrzyszewska, Ogrodowa, Złota, Szlenkierów, b) execution of construction works in accordance with the design documentation prepared by the Contractor and approved by the Contracting Authority, c) author's supervision over the execution of construction works in accordance with the design documentation prepared. 4. A detailed description of the subject-matter of the contract, the scope of work and the manner and conditions of implementation and receipt of the subject-matter of the contract are determined by: a) draft provisions of the contract - model contract, constituting Annex 6 to the FTZ, b) functional and utility program (PFU), which constitutes Annex 1 to the model contract. 5. In the proceedings in question, the contracting authority applies a social clause on the basis of Article 95 of the Public Procurement Law. The Contracting Authority requires that persons performing the subject of the contract and performing activities related to electrical and general construction works be employed by the Contractor or Subcontractor, on the basis of an employment contract, in accordance with the provisions of the Labour Code of 26 June 1974 (Journal of Laws of 2025, item 277 as amended). Detailed requirements regarding the method of documenting the employment of these persons and the Employer's powers to control this employment and sanctions for non-compliance with these requirements are included in the model contract. 6. Information on the division/non-division of the contract into lots. The contracting authority divided the works contract for the installation of outdoor lighting into lots, each of which is the subject of a separate procedure. The present proceedings concern one of the above-mentioned parts of the contract. 7. According to § 3 sec. 3 of the model contract, the Contractor is obliged to have a civil liability policy for the amount of insurance not less than PLN 2000000,00 (in words: two million zlotys 00/100), for the entire duration of the contract, which will include its contractual and tort liability. 8. The Contracting Authority informs that it intends to allocate PLN 2204102,00 gross to finance the contract awarded. 9. Warranty and warranty: The Contractor shall provide a guarantee for the construction works performed and the built-in materials and equipment for a minimum period of 36 months. The Contractor may propose to extend the above-mentioned warranty period to 60 months. The guarantee period for the works carried out and the materials and equipment incorporated is a criterion for the evaluation of tenders – see Chapter XIV of the FTZ. The warranty period is 60 months - § 11 sec. 3 model contract. 10. The customer does not require a local visit. 11. The contracting authority does not provide for the possibility of awarding contracts pursuant to Art. 1 point 7 of the PPL Act. 12. Subcontractors: all regulations and requirements regarding subcontracting, the Ordering Party included in the model contract, constituting Annex 6 to the FTZ. 13. The order must be completed within 56 weeks from the date of signing the contract, with the proviso that the project documentation must be completed within 30 weeks from the date of signing the contract.
