SUCCESSFUL DELIVERY OF FOIL BAGS FOR SELECTIVE COLLECTION OF MUNICIPAL WASTE FOR THE NEEDS OF COMMUNITY SERVICES ENTERPRISE SP. Z O.O IN TYSZOWCACH

… on the basis of the current state of knowledge of the Contracting Authority regarding the periodic demand for the bags being the subject of the contract. This means that the Ordering Party may purchase a smaller number of bags, which may not constitute a basis for the Contractor to make any claims as to the amount of actual payment due for the sale. In this respect, the Contractor shall not be entitled to any claim against the Ordering Party. The reduction in the quantity of the subject of the contract results from the specificity of the Contracting Authority's activity (mainly due to the change in the number of recipients of municipal waste). 3. Requirements for the subject-matter of the contract: 1) The Ordering Party requires that the delivered bags are brand new, made of polyethyl film with a thickness as described, 2) The bags must meet the requirements of Directive 94/64/EC confirmed in the Polish legal system, including, among others, with regard to material recycling (PN-EN 13430 or equivalent) and energy recovery (PN-EN 13431 or equivalent). The parameters of the bags must meet the requirements set out in PN-EN 13592 or equivalent for bags used for the separate collection of waste in households. 3) Bags intended for separate collection of waste should be: a) made of polyethyl film, enabling the content of the bag to be assessed (not applicable to black and grey bags), with a thickness as described, b) should have information on the types of waste collected as described. c) print on the bags made in a durable and legible manner, resistant to weather conditions, 4) Within 5 days from the date of signing the contract, the Contractor will provide the Ordering Party with 1 copy of each of the bags, in order to verify compliance with the requirements, 5) Deliveries will be made each time within 4 working days from the date of submitting the order to the Contractor, which will indicate the type and number of bags to be delivered, 7) Delivery is made at the expense and risk of the Contractor, to the Customer's headquarters from 7:00 to 15:00, 8) The Contractor will provide proof of the Contractor at each delivery, which requires confirmation by an authorized employee of the Ordering Party. 4. Detailed deadlines and the number of ordered bags will be reported by the Ordering Party to the Contractor by phone or e-mail. 5. Pursuant to Article 433(4) of the PPL, the Ordering Party guarantees the purchase of bags with a minimum value of 50% of the gross contractual remuneration.
