… from defects, come from one manufacturer, the same model and type and be compatible or with technical parameters higher than the requirements of the Ordering Party specified in Annex 4 to the SWZ, compatible (cooperating) with the devices, systems and software owned by the Ordering Party (i.e. the operating system MS Windows 10/11) and have standards and approvals allowing for marketing on the European Union market. If the technical specification indicates, in relation to the equipment, trademarks, patents or origin, source or specific process that characterizes the products or services provided by a specific contractor, they do not constitute a reference for the Contracting Authority or a description of the subject-matter of the contract in accordance with Art. 5 of the Public Procurement Act. They should not be taken into account by the Contractor when drawing up the tender. 4. For the subject of the contract, the specified parameters are minimum values, maximum if indicated, each device with better parameters, higher than specified, meets the requirements specified by the Ordering Party. 5. The Ordering Party informs that the colours given in the technical specification constituting Annex 4 to the SWZ are preferred by the Ordering Party. Notwithstanding the above, the Ordering Party requires that the devices offered by the Contractors are in dark subdued colors. 6. As part of the performance of the subject of the contract, the Contractor should deliver and bring to the place indicated in the Customer's registered office, i.e. ul. POW 24, 42-200 Częstochowa, the subject of the order complete, unused, brand new, free from defects, originating from the legal distribution channel specified by the manufacturer in the European Union and having a certificate allowing for marketing in the European Union - EU declaration of conformity, within the period offered by the Contractor in the tender form, however, the delivery date may not be longer than 30 calendar days from the date of signing the contract, provided that the final delivery date the Ordering Party accepts the date of signing the delivery and acceptance protocol by the Ordering Party, without reservations 7. The Contractor shall ensure that the packaging of the delivery item is such as is required to prevent damage or deterioration during transport to the place of delivery. 8. The delivered equipment must be marked with the CE mark in accordance with the requirements set out in the Regulation of the Minister of Development of 2 June 2016 on requirements for electrical equipment (Journal of Laws of 2016, item 806). 9. Where the subject-matter of the contract includes or may include an ICT product, ICT service or ICT process as identified in the recommendation referred to in Article 33(b) of Regulation (EC) No 207/2009, the contract shall be concluded on the basis of the information technology technology technology (ICT) product, ICT service or ICT process identified in the recommendation referred to in Article 33(c) of this Regulation. 4 of the Act of 5 July 2018 on the national cybersecurity system (Dz.
