… the right of option to the extent indicated in the procurement documents, at the prices specified in the tender, subject to the provisions of the draft contract, which constitutes Annex 5 to the FTZ. 4. The Ordering Party reserves that the part of the order specified as an option right is an entitlement and not an obligation of the Ordering Party. Execution of the option may or may not take place, depending on the financial capabilities of the Ordering Party. Failure to perform the contract in this respect will not cause any claims on the part of the Contractor. 5. If the right of option is exercised, settlement will take place on the terms included in the concluded contract. 6. A detailed description of the subject-matter of the contract is set out in part of the FTZ – Description of the subject-matter of the contract, which is attached as Annex 4 to the FTZ. 7. The contracting authority requires that the offered subject of the contract: 1) was brand new, produced in the current year for delivery, without any signs of damage, full-value; 2) it had technical and functional parameters not worse than those indicated in Annex 4 to the FTZ – Description of the subject-matter of the contract; 3) it has been marked with the CE mark; 4) is free from legal and technical defects preventing their use in accordance with the intended purpose; 5) in no way infringes the patent rights or other intellectual property rights of third parties; 6) it was placed in the original manufacturer's packaging protecting it against mechanical damage; 7) came from a legal distribution channel to the territory of the Republic of Poland. 8. The Contracting Authority requires the Contractor to provide, on the day of delivery, for each assortment, documentation drawn up in Polish, including: 1) a warranty card containing serial numbers of the assortment, the term and conditions of validity of the warranty, e-mail addresses, fax numbers to which repair reports can be submitted and telephone numbers from which all repair information can be obtained, 2) instructions for use in Polish. 9. The contractor must have the status of an authorized partner of the manufacturer of the offered subject of the contract in Poland confirmed in writing by the manufacturer. 10. In the event that the Contractor will not be able to fulfill the warranty obligations, the service will be taken over by the manufacturer. The contractor together with the offer is obliged to submit a statement confirming that the service will be carried out by the manufacturer or an authorized service partner of the manufacturer. 11. The Contractor is obliged to execute the order on the terms and conditions described in the Essential provisions of the contract, constituting Annex 5 to the FTZ. 12. The contracting authority does not allow variants to be submitted. 13. The Contracting Authority does not allow the subcontractor to be entrusted with the performance of a part of the contract. 14. Pursuant to Article 310 of the Act, the Contracting Authority may cancel the procurement procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been allocated to it. 15.
