… constitutes Annex 2 to the model contract, constituting Annex 2 to the FTZ. 4. In the proceedings in question, the contracting authority applies a social clause on the basis of Article 95 of the Public Procurement Act. The Contracting Authority requires that persons performing the subject of the contract and performing activities related to general construction works be employed by the Contractor or Subcontractor, on the basis of an employment relationship, in accordance with the Labour Code of 26 June 1974 (Journal of Laws of 2025, item 277 as amended). Detailed requirements concerning the method of documenting and verifying the employment of these persons and the Employer's right to control this employment and sanctions for non-compliance with these requirements are contained in the model contract, constituting Annex 2 to the FTZ. 5. Information on the division/non-division of the contract into lots. The contracting authority divided the works contract for the tracks and other surfaces into lots, each of which is the subject of a separate procedure. The present proceedings concern one of the above-mentioned lots. 6. According to § 3 sec. 2 of the model contract, the Contractor is obliged to have a civil liability policy for the amount of insurance not less than PLN 200,000.00 (in words: three hundred thousand zlotys 00/100), for the entire duration of the contract, which will include its contractual and tort liability. 7. The Contracting Authority informs that it intends to allocate a gross amount of PLN 197.210.87 to finance the contract awarded. 8. It's a guarantee. The Contractor shall provide a guarantee for the subject of the contract, including the built-in materials and equipment, for a minimum period of 36 months. The Contractor may propose to extend the warranty period for the completed subject of the contract to 60 months. The guarantee period for the subject-matter of the contract performed is a criterion for the evaluation of tenders – see Chapter XIV of the FTZ. 9. The customer does not require a local visit. 10. Subcontractors: all regulations and requirements regarding subcontracting, the Ordering Party included in the model contract, constituting Annex 2 to the FTZ.
