Due to the fact that the works contract will be a flat-rate contract in the event of the occurrence of more works in any item during the execution of the works, this cannot be considered as additional works with a demand for additional remuneration. The possible lack of certain works necessary to be carried out on the basis of the project documentation (including the implementing project) in the bill of quantities does not release the contractor from the obligation to carry them out on the basis of the project at the contractual price.
