1. Przewidywany do wykonania zakres robót przedstawia Opis przedmiotu zamówienia zawarty w Rozdziale III SWZ, w tym załączone dokumenty w postaci Projekt Techniczny, Projekt Wykonawczy, Specyfikacji Technicznej Wykonania i Odbioru Robót (dalej „STWiORB”), oraz Przedmiaru Robót. Z uwagi na ryczałtowy charakter umownego wynagrodzenia załączony „Przedmiar robót” stanowi element pomocniczy przy kalkulacji ceny ofertowej. Roboty muszą być wykonane zgodnie z SWZ, Projektem Technicznym, Projektem Wykonawczym, STWiORB oraz zasadami aktualnej wiedzy technicznej, obowiązującymi przepisami i normami w tym zakresie. W związku z powyższym, Wykonawca nie może żądać wynagrodzenia za prace nieujęte w „Przedmiarze robót”, a wykonane w trakcie realizacji przedmiotu zamówienia nawet wtedy, gdyby w czasie zawierania umowy w ogóle nie można było przewidzieć rozmiaru lub kosztów prac.
