… by persons authorized by the Ordering Party. The order may specify in particular the type, quantity and delivery date of the ordered assortment. 7. The Ordering Party reserves the right to purchase a smaller quantity of individual products than the quantities indicated in Annex 1 to the FTZ, in accordance with the current needs of the Ordering Party, subject to the minimum level of order performance guaranteed by the Ordering Party specified in the draft contract. 8. The Ordering Party guarantees the performance of the contract at a level not lower than 70% of the total gross value of the contract specified in § 4 sec. 1 of the draft contract, unless the limitation of the scope of the contract results from circumstances beyond the control of the Employer, which could not have been foreseen at the time of conclusion of the contract. 9. During the implementation of the contract, the Ordering Party may make quantitative transfers between individual assortment items specified in Annex No. 1 to the FTZ, in accordance with current needs, while maintaining the total gross value of the contract and the minimum level of implementation specified in paragraph. 8. 10. The Contractor shall ensure the continuity and liquidity of the supply of the range covered by the contract throughout its duration. 11. Dairy products delivered must be fresh, wholesome, free from defects and meet the requirements resulting from the applicable legal provisions, in particular regarding food safety, sanitary, technological and quality requirements. 12. Products supplied must bear the labelling required by applicable law, appropriate to the type of product concerned, in particular as regards the name of the product, the identity of the operator responsible for food information, the net quantity, the use-by date or the date of minimum durability and storage conditions, to the extent required by law. 13. The unit and grouped packaging of the delivered products must comply with the requirements set out in the applicable legislation and with the requirements specific to the type of product. Packaging must ensure that the product is adequately protected against contamination, damage and loss of quality. 14. The Contractor undertakes, as part of the remuneration specified in the contract, to deliver the subject of the contract to the place indicated by the Ordering Party, at his own expense and risk. 15. Place of delivery: Kitchen of the Hospital, Głogów, ul. It's Kościuszko 15. 16. The Contractor must have and apply procedures and systems to ensure food safety, including procedures based on the HACCP principles, as required by applicable law. 17. Detailed conditions for the performance of the contract, including the rules for placing orders, deliveries, receipt of products, complaints, the Contractor's liability, contractual penalties and amendments to the contract, are set out in the draft contract constituting Annex 3 to the FTZ.
