… Contractor will be obliged to train the personnel indicated by the Ordering Party in the field of service, maintenance and operating rules of the subject of the contract within 2 days from the date of installation. A detailed description of the subject of the contract shall specify: Annex 4a to the FTZ, covering technical projects and work plans. The Contractor is obliged to ensure the participation of persons with appropriate building rights or qualifications at the stage of contract performance, i.e. - building permits without restrictions in the installation specialty in the field of electrical and electricity networks, installations and equipment, - SEP E and D permits, - geodetic permits to the extent required by law and technical documentation. Documents proving the possession of the required qualifications and qualifications should be presented to the Ordering Party before the commencement of works, the performance of which requires the participation of a person with appropriate powers, if the obligation to submit them results from the provisions of law or contract documentation. At the same time, the contracting authority explains that the requirements regarding the rights of persons involved in the performance of the contract result from the applicable law and apply to the extent that they are required for the correct and lawful performance of the subject of the contract. The contracting authority informs that where it has described the subject-matter of the contract in the FTZ by reference to standards, European technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Public Procurement Act, the Contracting Authority allows solutions equivalent to those described and such reference is accompanied by the words ‘or equivalent’. The Contracting Authority indicates that the obligation to submit in the tender solutions equivalent to those described in the description of the subject of the contract and to demonstrate equivalence lies with the Contractor. Where the Contractor offers equivalent solutions, he shall include information on the use of equivalent solutions in the Tender Form in point 12. In such a case, the Contractor shall be required to prove equivalence, in particular by the means of proof in question submitted with the tender. The Contracting Authority shall consider as equivalent solutions a solution which, in the case of standards, technical assessments, technical specifications and technical reference systems, guarantees the achievement of the levels of parameters, functionalities and properties necessary to obtain technical certification and technical reference systems, whereby, in the case of providing standards, the Contracting Authority will automatically consider as equivalent newer versions of the same standards that are given in the description of the subject of the contract. In the case of functional and performance requirements, it guarantees obtaining the values accepted in the documents describing the subject of the contract in terms of the features, parameters and properties indicated therein. The quality requirements in connection with the use of the price criterion as a criterion weighing more than 60% relating to at least the main elements making up the subject-matter of the contract are set out in the description of the subject-matter of the contract and the draft contract. 2.
