The subject of the contract are successive deliveries of foodstuffs intended for the needs of current nutrition in the assortment and quantities included in the lists constituting Annexes 1 to 3. Delivery will be carried out successively on the basis of the needs of the Contracting Authority, in which each time the delivery date and the range of orders will be determined - excluding non-working days and didactic classes of the Contracting Authority and breaks resulting from non-working days. The Ordering Party points out that cyclical deliveries to the Ordering Entity should each time be adjusted by weight to the order placed. 2. The Contracting Authority reserves the right to limit the scope of the contract in individual parts, while maintaining the minimum value of the subject of the contract (defined in the concluded contract) at the level of 10% guaranteeing the Contractor the remuneration related to this scope of the contract. The specified quantity of groceries in the price form is an estimated quantity and may change (reduce or increase) during the performance of the contract. The above cannot constitute a basis for the Contractor to make claims for the purchase of the remaining quantity of products or for payment of the equivalent of unsolicited products or compensation for unsolicited products. 3. The food products to be delivered should comply with the current sanitary and epidemiological requirements and the rules of the HACCP system in mass caterers, inter alia: 1) have the appropriate quality specifications or attestations, 2) have the appropriate marking, i.e. the date of minimum durability and shelf-life, 3) have the appropriate temperature during transport and sanitary conditions of the vehicle, and the contractor must have the current required decisions related to this. Should any of the previous decisions expire or be revoked during the term of this contract, the Contractor shall be obliged to submit a new decision in this respect, no later than on the last day of the previous one. The lack of any required document confirming the possession of a valid decision or failure to supplement the documents within the time limit set by the Contracting Authority shall constitute the basis for withdrawal from the contract by the Contracting Authority with immediate effect and for charging the Contractor with the contractual penalty referred to in § 10 sec. 1 point 1.1 of the PPU or depending on the decision of the Contracting Authority to suspend the performance of the contract until the deficiencies are remedied within the time limit specified by the Contracting Authority. 4. At each request of the Contracting Authority, the Contractor is obliged to present for each product an appropriate certificate of compliance with the Polish Standard or European standards. 5. Quality requirements of the subject of the contract: 1) The Contractor shall supply first-class food products, fresh, complying with the quality standards applicable to the type of products in force in Poland, with the current dates and dates of delivery.
