The conditions under which the subject of the contract will be realized, as well as the rights and obligations of the contracting authority and the contractor, shall be in accordance with: the draft contract; the technical specification; the technical and price proposals for each lot. The contract to be concluded with the tenderer designated as the contractor for the lot concerned shall be valid for the duration of the draft contract. The contracting authority does not provide for the conclusion of a written contract for the implementation of OP 7. Pursuant to Article 21(6) of the Public Procurement Act, OP 5, OP 6 and OP 7 are awarded in accordance with the procedure valid for their individual estimated value – Article 20(4)(3) of the Public Procurement Act (direct award), given that the total estimated value of the items is below the threshold under Article 20(4)(3) of the Public Procurement Act and does not exceed 20% of the total estimated value of the contract.
