… public contract is reserved for the participation of specialized enterprises or cooperatives of people with disabilities. Persons may participate in the award of the contract provided that: At least 30 percent of their list is made up of people with settlements or disadvantaged people; Persons must have been registered as specialised enterprises or cooperatives of persons with disabilities for at least three years prior to the date of the opening of the contract; They can perform at least 80% of its object with their own machines, equipment and human resources. To fulfil the condition, they may use subcontractors or rely on the capacities of third parties if the subcontractors or third parties are specialised enterprises or cooperatives of persons with disabilities. Pursuant to Article 12(7) of the Public Procurement Act, bids may be submitted by interested parties other than those for whom the contract has been reserved, but their bids will be considered only if no bids are accepted by the persons mentioned above (specialized enterprises or cooperatives of people with disabilities).
