… 12(1)(1) of the Public Procurement Act have been met. 1 may participate in the award of public contracts under Art. 12 , para. 1, provided that at least 30 per cent of their list is made up of disabled or disadvantaged persons. In the cases referred to in Article 12(1)(1), the persons must have been registered as specialised enterprises or cooperatives of people with disabilities at least three years before the date of the opening of the specific public procurement procedure. Specialized enterprises or cooperatives of people with disabilities may participate in a public contract under Art. 1, item 1 of the PPA, provided that they can perform at least 80 percent of its object with their own machines, equipment and human resources. To fulfil the condition, they may use subcontractors or rely on the capacities of third parties if the subcontractors or third parties are specialised enterprises or cooperatives of persons with disabilities.
