All main tenders which cannot be awarded on their own merits will be excluded from the procurement procedure. --- Side offers are allowed Minimum requirements for ancillary offers: 1. All specifications, as listed in the execution planning and invitation to tender, must also be complied with for side offers. 2. Proposals for changes with regard to traffic safety, guidance, deadlines, construction procedures and other matters require the consent of all contracting authorities, competent authorities and all affected third parties and must be submitted with the ancillary offer. 3. Ancillary offers require a description showing all changes compared to the solution contained in the procurement documents (including disadvantages). If calculations (e.g. statics) or plans are referred to, they must be submitted in an audited form (e.g. statics) with the side offer 4. Material substitutions require proof of equivalence in use value on the basis of all characteristics, whereby the material is marked in the corresponding DIN, environmental compatibility or additional contractual condition (also specific to the state of Saxony-Anhalt). 5. Tenderers must prove the equivalence, feasibility and completeness of their ancillary offer by submitting it. For the building materials to be used, proof of environmental compatibility must be provided with the submission of the ancillary offer. 6. If it turns out only after the commissioning that the ancillary offer cannot be executed as offered, the additional costs incurred by the contractor shall be borne by the contractor alone. If the implementation of a lower-priced ancillary offer is not possible or not possible with the required equivalence to the draft invitation to tender, the contractor must implement the main offer (in accordance with the invitation to tender) at the cost of the ancillary offer. 7. Ancillary offers must take into account all risks arising from the conversion compared to the tender (including building ground risk). 8. The design and planning requirements of the client must be complied with; all the technical and formal conditions set out in the tender specifications must be met. 9. If ancillary offers are submitted that affect the content of these specifications, the tenderer's evidence must be enclosed that this is done in accordance with the planning. In the case of ancillary offers concerning the building plot, the statements of the soil surveys must be taken into account. The statements on the issue of contaminated sites are expressly referred to here. Ancillary offers for closures and diversions require that the necessary coordination between the tenderer and the competent road traffic authorities is carried out in advance and that they have been approved.
