Award procedure Laboratory equipment and sample preparation of the BTU Cottbus-Senftenberg
The text deals with a national procurement and procurement procedure according to the sub-threshold procurement regulation (UVgO) for delivery services (laboratory equipment and sample preparation) of the Brandenburg University of Technology Cottbus-Senftenberg.
The documents come from Germany, with specific reference to the state of Brandenburg and its Brandenburg Public Procurement Act (BbgVergG) as well as German regulations such as VOL/B, GWB and UVgO.
The perspective is that of a German contracting authority that defines the conditions of participation, tender requirements and contractual conditions for tenderers, including those from other EU countries and third countries.
A clear set of documents will be provided for what the tenderer is required to submit and what minimum requirements apply.
For example, the BTU tender letter with integrated self-declaration on exclusion grounds (‘UVgO BTU tender letter form set + self-declaration on exclusion grounds’) and a content-related tender with net tender prices per lot must be submitted.
In addition, such documents as proof of registration in a professional or trade register or other proof of the permitted practice of the profession are required.
Furthermore, as can be seen, for example, from Form 5.3, a legally binding signed ‘Agreement to comply with the minimum requirements under the Brandenburg Public Procurement Act’ must be attached, otherwise the tender will be considered incomplete.
In addition, if preference is claimed under the Women's Promotion Ordinance, form 4.5 and the corresponding gender-specific employee and wage information can be submitted.
Specific quantitative suitability requirements such as minimum turnover or insurance coverage are not mentioned in the sections; however, a self-declaration of good repute (no serious misconduct, no grounds for exclusion under insolvency law, compliance with labour and social law obligations) is expressly required, with the possibility of ‘self-cleaning’ by means of appropriate evidence.
With regard to the scope of the contract (Scope), the terms of reference “Laboratory equipment and sample preparation – Lots 1 to 7” define in detail what needs to be delivered, where and by when.
There are seven separate lots (e.g. multi-frequency ultrasonic bath, analytical balances, vibrating mill with cryo-cooling, sample division system, pressure filtration device, electric table centrifuge), each containing minimum requirements for technology, performance data, scope of delivery and CE conformity.
Show all 31 statements
Such requirements include, for example, the specification of maximum load and readability for scales, sample volume, operating pressure, materials (stainless steel 1.4401 or equivalent), safety functions (unbalance detection, lid locking) and accessories (rotors, antistatic units, weighing tables, cryo-cooling systems).
The place of delivery and performance is expressly the Senftenberg Campus of the BTU (building 14C, FG Physikalische Chemie), with delivery condition ‘free use office (DDP)’ including transport, packaging and customs costs by the contractor.
The end dates are clearly identified: The closing date for the submission of tenders is 06.11.2026 at 12:00, the closing date for the award and validity of tenders is 04.12.2026 and the latest delivery date for all lots is 8.1.2027; in addition, the indication of the delivery time in weeks from the placing of the order with the offer must be submitted and not submitable.
As regards the award criteria and their weighting, Part D of the Tender Specifications stipulates that the evaluation will be carried out separately for each lot and that the only award criterion will be the price.
The test is carried out in stages: First, a formal check that excludes late tenders; control of the minimum technical requirements per lot and across lots, also excluding tenders that do not meet the requirements; Finally, a price scoring which, among the remaining tenders, will be awarded to the tender with the lowest net offer price.
If the price is the same, the lot decides; Qualitative or temporal sub-criteria (such as delivery time or warranty period) thus serve only as a component of the offer, not as independent evaluation criteria.
A special preference for tenderers is only provided for under the Women’s Promotion Regulation, but only if tenders are ‘equivalent to the most economical tender’ or up to 20% above its price – and only under further conditions, e.g. the obligation not to reduce the proportion of women and the proportion of women’s wages by the end of the contract or year.
Risks and special conditions include various points that are regulated by application conditions, supplementary award conditions and contractual conditions (VOL/B and ZVB Bbg).
For example, it is mandatory that tenders are submitted exclusively electronically via the Brandenburg public procurement marketplace using the bidding tool and in approved file formats; a transmission by e-mail or via the communication area necessarily leads to exclusion.
In addition, a simple electronic form (text form with the name of a natural person) is sufficient; If the name, a required signature or a required signature is missing, the offer will be excluded.
Changes or additions to the procurement documents are inadmissible and lead to mandatory exclusion from the procedure.
There is a period of validity until 04.12.2026 during which the tenderer will be bound by his tender.
Contractual penalties are introduced in particular via Form 5.3 and the BbgVergG: in the event of culpable reductions in fees or breaches of control obligations, contractual penalties of 1% of the order amount per case (maximum EUR 25,000) and a total of up to 5% of the order amount (maximum EUR 250,000); Infringements can also lead to the blocking of orders with entry in a central blocking list.
Guarantees (guarantees or deposit of funds) are in principle only permitted under VOL/B from the contract value of EUR 50,000 and must meet certain formal requirements.
Subcontractors are only allowed under certain conditions; they must be designated, their suitability must be demonstrated, there are obligations to pass on the minimum requirements (BbgVergG) and the contractor may subcontract only on the basis of competitive aspects; In addition, cartel declarations, membership of agreements under the GWB and strict compliance with the UVgO and GWB rules must be observed.
There are clear priority rules for inconsistencies or corrections within the documents.
The General Terms and Conditions VOL/B stipulate that in the event of contradictions in the contract, the order of precedence shall apply: first the service description, then special contractual conditions, then supplementary, additional and, if applicable, general technical contractual conditions, and lastly the general contractual conditions VOL/B.
In addition, different terms and conditions of business, delivery or payment of the contractor are expressly not part of the contract, unless they are confirmed in writing by the client.
Such words as ‘The tender documents referred to in the form “CSX 43 – Compilation of documents to be submitted” are attached’ are clarified by the ‘Compilation of supporting documents to be submitted’ (e.g. in the annexes) specifically sent with the cover letter; This depends on the current compilation of the BTU, which requires, among other things, the BTU tender letter with self-declaration, the content of the tenders with prices, proof of register and, if applicable, forms 4.5 and 5.3.
Only the contracting authority's tender documents are binding. As of: 29/10/2026
