Procurement of a mobile excavator for the construction yard of the city of Lauchhammer as a new, demonstration or used vehicle

Regarding what the bidder must submit and minimum qualification, the documents require with the offer: the Angebotsschreiben (Formblatt VHB 633), the completed “Leistungsverzeichnis und Preisblatt”, the “Eigenerklärung zur Eignung”, the Brandenburg minimum-pay agreement Formblatt 5.3 and, if subcontractors are used, Formblatt 5.4 plus the Verzeichnis der Nachunternehmerleistungen (VHB 233). Such as highlighted in the Zusammenstellung einzureichender Unterlagen, bidders must also submit technical data sheets for vehicle, engine and body, guarantee conditions, the Sonderformular Russland‑Embargo, and a service-book proof with inspection intervals when offering a demo or used machine. The Eigenerklärung zur Eignung covers registration in trade/professional registers, insolvency status, non-existence of exclusion grounds under §§ 123, 124 GWB, proper payment of taxes/social security, membership in a Berufsgenossenschaft, and existence (or promised establishment) of sufficient business liability insurance, including coverage limits for property, financial, and personal damage.

On award criteria and weighting, the procedure follows UVgO § 43 and evaluates the most economically advantageous tender via a price–performance approach. Such as explained in the Leistungsbeschreibung and Bewertungsmatrix, three criteria are used: (1) price (60% / up to 60 points, scored by a formula where the lowest gross price gets 60 points and others proportionally less), (2) delivery time from Zuschlag to complete, contract-compliant delivery (20% / up to 20 points, stepped scale from ≤2 months to >6 months), and (3) additional use-related equipment beyond the mandatory features (20% / up to 20 points, with fixed points for extras like tiltrotator, hydraulic quick coupler, various grapples, bucket, and Taklock system). The sum of points determines the ranking; if total points are equal, the lower price prevails. The Frauenförderverordnung adds a preference rule: if a bidder submits Formblatt 4.5 and is found to have a higher women’s share and women’s wage share, they may receive the award when equal in economic value or even be allowed to “enter” the best offer if their price is no more than 20% higher.

On risks and special conditions, the documents contain several contractual safeguards. Such as Formblatt 5.3 and 5.4, bidders commit to pay at least the Brandenburg minimum hourly wage (currently 13.00 €; federal MiLoG 13.90 € from 1.1.2026) for workers involved in delivery and associated services, and accept contractual penalties: 1% of the contract sum per proven case (per worker per month) of unlawful wage reduction or refusal of controls, up to 5% of the contract sum and capped at 25,000 € per case / 250,000 € total. The ZVB-Bbg sets fixed prices including all ancillary costs, requires free delivery to the place of use, and grants the contracting authority rights of Güteprüfung, rejection, defect rectification at contractor’s cost, and a right to withdraw or terminate for certain breaches (e.g. violation of VOL/B subcontracting rules or corruption). Warranty periods are 24 months for new devices and 12 months for demo/used devices; VOL/B and ZVB-Bbg extend certain defect rights up to 5 years for safety-related characteristics. For sanctions risk, the Sonderformular Russland-Embargo requires bidders to confirm no direct or significant (>10%) Russian involvement among bidders, subcontractors, or key suppliers throughout the contract. Bidders are bound by their offer until the end of the binding period specified in the invitation; incomplete or unsigned forms, incorrect submission channel (e.g. via e-mail instead of the VMPConnector Bietertool), or exceeding the 125,000 € gross budget lead to exclusion. Questions can only be submitted via the Vergabemarktplatz communication tool; telephone and e-mail questions are explicitly not accepted. No site visit is stipulated as mandatory, but delivery and acceptance occur on-site, with obligatory training, documentation handover, and signed protocol.

On contradictions or corrections, the documents themselves clarify how conflicts are resolved. Such as the ZVB-Bbg (1) states the order of precedence of contract documents: first the offer and Leistungsbeschreibung including any contractual annexes; then any Ergänzende Vertragsbedingungen; then the ZVB-Bbg; then the general VOL/B terms. The Aufforderung zur Angebotsabgabe (Form 631) and the Zusammenstellung einzureichender Unterlagen are consistent with the Leistungsbeschreibung regarding required forms and electronic submission via the Vergabemarktplatz; where 631 mentions several possible submission formats (text, advanced or qualified signature, or written), the specific notes on the platform restrict valid tenders to those submitted via the Bietertool, not via the communication tool or e-mail. In apparent overlaps between VOL 06 Bewerbungsbedingungen (which are “zum Verbleib beim Bieter bestimmt, nicht mit dem Angebot zurückgeben”) and the newer UVgO/VHB-Bbg forms, the more specific instructions in the Aufforderung (631), Leistungsbeschreibung, and Brandenburg forms (3.1 Unterlagenliste, Russland-Embargo, Form 5.3/5.4, Form 4.5 for Frauenförderung) apply.
