Vergabeunterlagen für die Lieferung eines Multifunktionsfahrzeugs mit Winterdiensttechnik (Stadt Bernau bei Berlin)
The input text consists of German public procurement documents for the City of Bernau bei Berlin (Germany) concerning the supply of a new multifunctional vehicle (Geräteträger) with winter service equipment for the municipal depot.
It contains the “Aufforderung zur Angebotsabgabe”, Bewerbungsbedingungen, contractual conditions, additional state contract conditions and a range of standard forms (insurance, turnover, exclusion grounds, joint bidding, subcontracting, minimum wage / BbgVergG, Frauenförderung, etc.).
The point of view is that of a German contracting authority applying the UVgO, GWB, Brandenburgisches Vergabegesetz, VOL/B and state-specific ZVB-Bbg.
Regarding what the bidder must submit and minimum qualification requirements, the documents specify that only the original form sheets provided may be used and all documents listed in Form 3.4 “Zusammenstellung der Angebotsunterlagen” must be submitted completely.
As such, bidders must provide: the completed offer letter (Form 3.3), the Leistungsverzeichnis including the price sheet (all price fields filled, no changes), the “Erklärung Umsatz” showing total net turnover for 2023–2025 with at least 300,000 EUR p.a.
(for joint bids the sums count), the “Erklärung zum Versicherungsschutz” confirming a professional/business liability insurance with minimum cover per claim of 1,000,000 EUR for personal injury, 1,000,000 EUR for property damage and 50,000 EUR for financial loss (or an irrevocable insurer’s cover note), proof of registration in trade/handels register, Form 4.1 “Eigenerklärung Ausschlussgründe” (for bidder, each JV member and each supporting/subcontractor), and, where applicable, Forms 4.2 (JV), 4.3 (subcontracts/eignungsleihe) and 4.4 (commitment of other companies).
As special statutory requirements under Brandenburg law, Form 5.3 “Vereinbarung Mindestanforderungen BbgVergG” must be signed and attached on pain of exclusion; Form 5.4 is required where work is passed to subcontractors or labour providers.
Additionally, bidders must enclose a technical data sheet for the offered machine, proof of manufacturer authorisation if they are not the manufacturer, and the three “Eigenerklärungen” for guarantee duration (2a), service (2b) and spare parts delivery time (2c).
Bidders who wish to be treated as preferred under the Frauenförderverordnung must also submit Form 4.5 with gender-disaggregated staff and wage data.
Concerning the scope of the contract (what, how much, where, when), the subject of both the procedure and the contract is the one-time delivery of one factory-new multifunctional vehicle (Geräteträger) equipped with winter service technology for the Bauhof (works yard) of the City of Bernau bei Berlin; there is no lot division.
The contractual documents clarify that the contract starts with award (“Zuschlag”) and ends after complete performance, at the latest upon delivery of a licensed and operational vehicle by 31.05.2027, without need for termination.
Show all 31 statements
The performance location / place of delivery is Bernau bei Berlin, specifically the Bauhof / receiving municipal service department, with deliveries “frei Verwendungsstelle” under the ZVB-Bbg; the additional contract conditions repeat that the place of performance and, as far as legally possible, the place of jurisdiction is Bernau.
The bid and all correspondence must be in German, bids may be submitted electronically via the Vergabemarktplatz Brandenburg in text form (or in writing in a sealed, labelled envelope), and bidders are bound by their offer until the end of the binding period indicated in the contract notice.
Any questions on the tender must be submitted exclusively via the Vergabemarktplatz at the latest six calendar days before the offer deadline; answers are distributed anonymously to all participants and become an integral, binding part of the tender and contract.
Regarding award criteria and weighting, the bidder with the economically most advantageous tender is selected based on a points model set out in section E of the Bewerbungsbedingungen.
As such, there are three main award criteria: 1) Price with a weighting of 80% (max. 800 points), 2) Guarantee (duration of warranty) with 10% (max. 100 points), and 3) Service with 10% total, subdivided into service concept 5% and spare parts delivery times 5% (together max. 100 points).
For the price criterion, the lowest-priced bid receives 800 points; other bids receive proportionally fewer points according to the formula: (price of lowest bid / price of bidder B) × 800.
For guarantee, the minimum requirement is 24 months; 24 months equal 50 points, less than 48 months 75 points, and more than 48 months 100 points.
For service, the minimum requirement is a maximum distance of 25 km between the next service workshop and the place of performance; if service is performed directly at the Bauhof, 50 points are awarded, if the workshop is < 25 km, 25 points.
For spare parts delivery, critical parts (e.g. hydraulic pumps, engine components) delivered in < 24 hours earn 50 points, delivery in 24–48 hours gives 25 points, and > 48 hours 0 points.
The total score equals the sum of the sub-scores, with a maximum of 1,000 points determining the top-ranked (economically best) offer.
As to risks and special conditions, several contractual and procedural provisions are noteworthy.
Time is of the essence: the fixed delivery deadline is 31.05.2027; if the contractor culpably misses this date, they automatically fall into delay, the contracting authority may set a final 7-day grace period, and if that also lapses fruitlessly, the performance part converts into an “Abrechnungsverhältnis” with possible further damages claims instead of performance.
Contractual penalties are stipulated in various contexts: such as under the BbgVergG minimum-wage agreement, where each proven wage underpayment or breach of control obligations entails a contractual penalty of 1% of the contract sum per case (capped at 25,000 EUR per case and 5% / 250,000 EUR overall), and under the anti-corruption clause, where a violation results in a penalty of 5% of the net contract amount and allows extraordinary termination.
The contractor must maintain professional liability insurance for at least the same cover amounts as the suitability requirement for the entire warranty period; any lapse must be reported and remedied immediately.
Subcontracting and reliance on third-party capacities (Eignungsleihe) are strictly regulated: the bidder must declare in Form 4.3 which parts are subcontracted or which capacities are borrowed, obtain commitments via Form 4.4, and submit exclusion declarations (4.1) for each such company; any change of JV membership or of named supporting companies after the bid deadline can lead to exclusion, except where replacement is expressly permitted under UVgO-like rules.
Multiple main offers and alternative bids are expressly prohibited and cause exclusion if nonetheless submitted; changes to tender documents are unzulässig, and only one complete, consistent main offer is allowed (revised offers must withdraw the previous one before the deadline).
On contradictions or corrections, the documents themselves define a priority order for conflicting statements.
The contract conditions (§ 2) state that, in the event of discrepancies, contractual parts apply in this order: a) the tender documents including the performance description and any clarifying notices from the procurement procedure (with “the last notice taking precedence” in case of conflicting clarifications), b) the Leistungsverzeichnis with price sheet, c) the specific contractual conditions, d) the final offer, e) the additional contract conditions of the State of Brandenburg (ZVB), including the BbgVergG minimum-requirements agreement, f) the general conditions VOL/B, g–i) the three self-declarations on guarantee, service and spare parts delivery.
This explicit hierarchy resolves potential contradictions, meaning that, for example, clarifications issued via bidder questions and answers and the performance description override conflicting clauses in later-ranked documents or general terms; similarly, the Buyer’s forms and instructions in the Bewerbungsbedingungen take precedence over conflicting supplier GTCs, which are expressly excluded from becoming part of the contract.
Only the contracting authority's tender documents are binding. As of: 27/10/2026
