Public Tender: Cleaning and Maintenance of Gully Pots in Koblenz (Germany)
The input text concerns a public procurement procedure in Germany (City of Koblenz, federal state of Rheinland-Pfalz) under German sub-threshold procurement law (UVgO/VOL/B) and with references to EU law (DS-GVO, AEntG, EU-Mitgliedstaaten).
It describes the tender “Reinigung und Wartung von Sinkkästen” (cleaning and maintenance of gully pots) including the invitation to tender, application and offer forms, contract conditions, and guidance on tariff compliance and minimum wages applicable in Rheinland-Pfalz.
The documents specify in detail what bidders must submit and what minimum qualification requirements apply.
Such as, with the offer bidders must use the prescribed forms: Form 633 (offer letter), the priced bill of quantities/price sheet B‑1, and—unless they are listed in an official prequalification register—Form 124 LD (self-declaration of suitability) or alternatively proof of prequalification.
There is also a mandatory Mustererklärung (model declaration) under the Landestariftreuegesetz (LTTG) on tariff compliance and minimum wage, and a data protection declaration/TOMs (Annex A under DS-GVO).
For bidder consortia, Form 234 (Bietergemeinschaftserklärung) is required on request.
The self-declaration covers, such as, turnover for comparable services in the last three financial years, confirmation of comparable references in the last three years (later to be specified with 3 reference certificates), information on staff numbers (average staff by wage group, including management), registration in trade/handicraft/Chamber of Industry and Commerce registers, and confirmations of proper tax and social security payments (tax clearance, social security and accident insurance clearances, exemption under § 48b EStG).
For prequalified companies, the PQ register entry suffices initially; underlying certificates must be produced upon request, including for subcontractors if they are used.
Regarding the scope of the contract, the performance object is the wet cleaning and maintenance of gully pots (Sinkkästen) in the entire urban area of Koblenz.
Such as, the performance description (Beschreibung der Leistung) defines that approx. 15,000 gully pots are to be cleaned in each of three campaigns per year: spring, summer and autumn (thus about 45,000 operations per year), with execution periods specified in detail: spring 18.01–06.05, summer 07.05–25.08, autumn 26.08–14.12.
The overall contract period given in the special conditions is from 18.01.2027 (start of performance) to 14.12.2027 (end of performance).
Award criteria and their weighting are clearly defined and largely price-driven.
Show all 26 statements
Such as, both the “Beschreibung der Leistung” (A‑8) and the invitation (Form 631, and the notice) state that the sole formal award criterion is the price, and that the evaluation method is “niedrigster Preis” (lowest price).
The “Angebotswertung” section of Form 631 further explains that the evaluated price is the recalculated offer sum, including unconditional discounts.
In addition, legal preference rules apply in cases of economically equal offers: there is a bonus of 15% on the evaluation price for recognized workshops for persons with disabilities and 10% for Inklusionsbetriebe, and tie-breaker preferences in favour of companies providing training places and companies with women’s advancement measures, each only within the limits of procurement law and not if one of the equal offers comes from a foreign bidder.
The tender includes several risks and special contract conditions that bidders must consider.
Such as, offers must be submitted exclusively electronically via the e-procurement platform by 04.11.2026, 09:30, with the required form of electronic signature, and the offer is binding until the end of the binding period on 03.12.2026.
The general contract basis is VOL/B plus Special Conditions (Form 634) and Additional Conditions (Form 635).
There are contractual penalties for delay: for each full week of delay 0.2% of the non-usable part of the performance, capped at 5% of the net contract sum; additional separate contractual penalties of 1% per culpable breach (up to 10%) apply for violations of LTTG obligations (tariff/m最低 wages) and, in serious cases, there is a right of termination for cause and potential exclusion from further tenders for up to three years.
A performance security (Sicherheitsleistung) of a certain percentage of the gross contract sum may be required where the contract exceeds 50,000 EUR (net) and where it is exceptionally necessary, to be furnished by cash deposit or an unconditional performance bond on the specified terms.
Subcontracting is addressed indirectly: bidders must carefully select subcontractors, ensure their compliance with LTTG, collect their declarations and, on request, supply self-declarations or PQ numbers; separate security declarations for subcontractors (Form 126) can be demanded.
Questions and ambiguities must be communicated “unverzüglich” via the platform before offer submission; there is no explicit site visit requirement mentioned.
Electronic invoicing in line with the Rhineland-Palatinate E‑Rechnungsverordnung may be required by 01.01.2027; invoices not complying with these e-invoicing rules do not trigger payment default.
Such as, Form 632 (general application conditions) describes generic rules on Nebenangebote (alternative bids), whereas the specific invitation (Form 631, section 5.1) explicitly states that Nebenangebote are not permitted for this procedure; hence, the specific statement in the invitation overrides the generic form, so alternative bids are not allowed.
Similarly, in one place the procedure type is labeled VOL/A and in another UVgO; the operative rules are clearly those of UVgO as stated in Form 632 and 631 (“Vergabeverfahren gemäß UVgO”), while VOL/B continues to apply as contract conditions.
No explicit contradictions were found regarding contract periods or quantities: the notice and special conditions consistently give 18.01.2027–14.12.2027 as performance period, and the performance description consistently speaks of three cleaning cycles of approximately 15,000 gully pots each per year.
Only the contracting authority's tender documents are binding. As of: 27/10/2026
