… this framework agreement will have a probable size between 1,000 € excl. VAT and 50,000 € excl. VAT. The calls depend on various external factors, including coherence with other renovation projects or new construction projects, freeing up premises, etc. and can therefore not be determined in advance. 4. Thus, the contracting authority will initially conclude a framework agreement with a maximum of three tenderers. If only one or two regular tenderers present themselves, the Contracting Authority will conclude a framework agreement with one or two tenderers. All conditions are defined in the framework agreement. The participants will not be put back into competition. 5. The contracting authority will thus be able to call up works under the waterfall system in accordance with the conditions laid down in this framework agreement. 6. The Contracting Authority will thus be able to call up works in accordance with the conditions set out in this framework agreement from the Entrepreneur who is the first to be included in the ranking. In the event that the Entrepreneur, who is first in ranking, cannot respond to the call, the Tenderer is entitled to place the call with the Entrepreneur who is next in ranking. If this Entrepreneur is not able, the Entrepreneur will be placed as a third party in the ranking. 7. The Tenderer can always consult the Entrepreneur who is party to the framework agreement in writing and, if necessary, ask him to supplement his offer. 8. The duration of this framework contract shall be 6 years from the date of award. Subject to a notice period of 3 months, the Contracting Authority may, without giving any reason, terminate the framework agreement at any time. In order to bridge the transition period to a new framework agreement, the contract may be extended by a maximum of 3 times 2 months on a proposal from the Contracting Authority. 9. The maximum total order amount of the total framework contract (over the entire duration) is limited to 1,400,000 € excl. VAT. The maximum value indicated was not determined on the basis of the probable quantities included in the summary measurement. Consequently, that maximum value does not constitute an indication of the amount of the tender which may be accepted. On the other hand, it concerns the maximum value of that framework agreement, determined on the basis of the maximum quantities that can be ordered for all the contracts that can be called up within that framework agreement.
