What the buyer is looking for
The contracting authority is preparing the acquisition of four (4) new BEMU electric battery-powered railway vehicles (hereinafter also referred to as ‘Guaranteed Number’ and ‘Vehicles’) for the purpose of their future use in the provision of public passenger transport services by rail for the Ústí nad Labem Region within the BEMU operational group of Plum Railway units. The Ústí nad Labem Region declared its intention to conclude a public passenger transport service contract for 15 transport years with the contracting authority for this purpose, the expected start date from 2030 (with a possible postponement of the start of performance to 2032). … reflected these requirements to an appropriate extent in the terms of reference of this public contract. In connection with the planned acquisition of Vehicles and their future use for the provision of public services for the Ústí Region, the contracting authority intends to seek to ensure co-financing of Vehicles within the 2nd round of the call from the TRANSGov programme: Modernisation of public transport (ModF call number: TRANSGov No 1/2024). The contracting authority thus (potentially) meets the definition of a contracting authority under Section 4(2) of the Act. With regard to the intended co-financing of Vehicles, the contracting authority requires participants in the procurement procedure to familiarise themselves in detail with the conditions and rules of the above-mentioned subsidy programme, including the conditions of the relevant call, to the extent relevant to the subject matter of this public contract. Participants are obliged to take these conditions into account in the preparation of their tenders and to respect them in the subsequent performance of the contract, if applicable. The public contract is awarded in a negotiated procedure with publication pursuant to Section 60 of the Public Procurement Act, because the contracting authority has concluded, with regard to the terms of the tender procedure, that its specific need cannot be met without an adequate adjustment of the solutions already available on the market and, given the complexity of the subject of performance, the fact that the technical conditions of the subject of performance cannot be sufficiently defined solely by reference to technical standards within the meaning of Section 90(1) and (2) of the Public Procurement Act and its direct link to the terms of the tender procedure, it is necessary to hold negotiations with the participants in the tender procedure. The purpose of this above-threshold public contract for supplies awarded in a negotiated procedure with publication in accordance with the provisions of Section 60 et seq. The ZZVZ is the conclusion of a contract for the supply of Vehicles together with the provision of service services, as well as the possibility of exercising an option right beyond the Guaranteed Number and to extend the period of provision of service services, all within the meaning of point 2.9 of this tender documentation. The result of the procurement procedure will be the conclusion of a contract for the performance of a public contract with a single contractor.
