… a sufficient number of suppliers will not prove that the qualification has been met to the required extent, the contracting authority is entitled, in accordance with Section 133(2) of the Act, to conclude a framework agreement only with those suppliers who have fulfilled those requirements. Individual public contracts (minitendry) will be awarded on the basis of a framework agreement in accordance with the procedure with the reopening of competition between the participants in the framework agreement pursuant to Section 132(3)(a) of the Act, in accordance with Section 135 of the Act, on the basis of a written invitation from the contracting authority to submit a tender to all participants in the framework agreement made using the electronic tool E-ZAK available at: https://ezak.cnb.cz/. The subject of the implementation of the framework agreement, or public contracts awarded on the basis of the framework agreement, is to ensure the provision of strategic and transactional advisory services consisting in specialised advice and assistance in the resolution of a financial market crisis, in particular in the assessment and possible application of measures for the transfer of activity to a private acquirer pursuant to Section 96 et seq. of Act No 374/2015 on financial market recovery and resolution, as amended (hereinafter referred to as "the ZOPRK"), the transfer of activity to a bridge institution pursuant to Section 102 et seq. ZOPRK, transfer of activity to a person for asset management pursuant to Section 113 et seq. ZOPRK, or assistance in the evaluation of a business reorganisation plan pursuant to Section 150 et seq. ZOPRK, in relation to the obliged entity or group. The conclusion of a framework agreement within the meaning of Section 131 et seq. of the Act will allow the contracting authority to award public contracts for the agreed performance according to its current needs. A more detailed specification of the subject-matter of the contract, or of the contracts awarded on the basis of the framework agreement, is contained in the draft framework agreement.
