The conditions under which the subject of the contract will be realized, as well as the rights and obligations of the Assignor and the Contractor, are in accordance with the Draft Contract, the Technical Specification, the Technical and Price Proposals of the Contractor for the respective position. At the time of the announcement of this public procurement no funding was provided, in connection with which the procedure is announced and conducted in the hypothesis of Art. 114 of the Public Procurement Act. The value of each of the contracts to be concluded with the successful tenderer for the lot concerned will be equal to the value of the price offer of the successful tenderer, including VAT. The estimated value indicated by the Contracting Authority for each item is maximum and includes all payments to the future contractor. A participant whose Price Offer exceeds the value of the item including VAT will be excluded from the procedure. This procedure covers lots № 1 to № 8 of a public procurement procedure for the ‘Supply and servicing of motor vehicles for the needs of the Municipality of Plovdiv and its structural units’ under a total of 11 lots. Pursuant to Article 21(6) of the Public Procurement Act, subject to the conditions of value laid down in the provision, the Contracting Authority will directly award the implementation of lots № 9, № 10 and № 11, as follows: Lot № 9: ‘Supply of a charging station for the needs of the Community Centre for Children and Families – Plovdiv’, estimated at EUR 1 666.67 excluding VAT or EUR 2 000.00 including VAT; Lot № 10: ‘Supply of a new off-road quad (ATV type) for the needs of the Plovdiv 112 State Fund’, estimated at EUR 8 491.67 excluding VAT or EUR 10 190.00 including VAT; Lot № 11: ‘Supply of a new two-wheel motor vehicle (motorcycle) for the needs of the Plovdiv 112 State Fund’, estimated at EUR 4 991.67 excluding VAT or EUR 5 990.00 including VAT. When examining the bids of the participants, the Commission shall apply the procedure of Article 72 of the Public Procurement Act, requiring the submission within 5 days of a justification for the manner of formation of the total value of the Price Offer, including VAT, proposed in the bid of a participant, where it is more than 20 per cent more favourable than: 1. the average value of the offers of the other participants with VAT according to the indicator for evaluation "Proposed price" (PP) - when three or more offers are admitted to evaluation; 2. the announced estimated value for the item with VAT - in case of one or two offers admitted to evaluation.
