The period for performance of the contract is 24 (twenty-four) months from the date of registration of the first schedule for the supply of net active electricity after the entry into force of the contract or until the maximum permissible value under the contract is reached, whichever comes first. On the basis of Article 21(1) of the PPA, in conjunction with Article 116(1)(1) of the PPA, in conjunction with Article 5(2) of the PPZOP, the contracting authority provides for the possibility of applying the option: ‘Amendment of the contract’ should be understood as meaning that if, during the term of the contract, the estimated volume of electricity MWh referred to in this documentation and the technical specificity is reached or when, at the time of expiry of the contract, the contracting authority does not have a contract in force with a selected contractor for the supply of electricity, the contract concluded for the award of this public procurement may be amended on the basis of Article 116(1)(1) and/or (3) and (2) of the PPA, and its validity may be extended by signing an additional agreement between the parties for a period until the conclusion of a new contract, but not by more than 6 months, and in compliance with the requirements of the PPA, the contracting authority states that the volume of the option is about 1300 MWh of additional supplies, and its value may not exceed EUR 190 000 excluding VAT. The estimated value of this contract is EUR 776 904,00 excluding VAT. The total estimated value of the contract with the option included is EUR 966 904 excluding VAT and its estimated volume with the option included is EUR 6 348 MWh, which are the maximum value and volume of supplies of the contract that awarded the performance of this public contract. PAYMENT CRITERIA: The contract is awarded on the basis of the ‘lowest price’. The most economically advantageous tender is determined on the basis of the award criterion ‘lowest price’ referred to in Article 70(2)(1) of the Public Procurement Act. For this procedure, the ‘lowest price’ criterion is the lowest price offered by a participant in the procedure for the administration of the supply of 1 MWh of electricity.The price of the flat-rate allowance is not subject to change until the contract has been fully performed. In the case of one or two tenders admitted to evaluation, an objective basis for comparison (comparable value) under Article 72(1)(2) of the Public Procurement Act has been determined, amounting to EUR 3.00 excluding VAT for a flat-rate allowance. The price of a flat-rate allowance may not be higher than EUR 4 per 1 MWh. Lots: A public contract shall not be divided into lots. The contracting authority complied with Article 46(1) of the Public Procurement Act and considered that the division into lots was inappropriate. Separation of the supply of electricity cannot be achieved as the procurement is only for one product with a specified quantity.
