Gemäß § 130a Abs. 8 Satz 1 SGB V können Rabattverträge nur mit pharmazeutischen Unternehmern i. S. d. § 4 Abs. 18 AMG (bzw. einer Vertragsgemeinschaft aus pharmazeutischen Unternehmern) abgeschlossen werden, wobei sich die Eigenschaft der Vertragspartner als p… ▸▾
Gemäß § 130a Abs. 8 Satz 1 SGB V können Rabattverträge nur mit pharmazeutischen Unternehmern i. S. d. § 4 Abs. 18 AMG (bzw. einer Vertragsgemeinschaft aus pharmazeutischen Unternehmern) abgeschlossen werden, wobei sich die Eigenschaft der Vertragspartner als pharmazeutische Unternehmer auf die jeweils angebotenen Arzneimittel bezieht. Es wird darauf hingewiesen, dass Arzneimittel im Geltungsbereich des AMG nur durch einen pharmazeutischen Unternehmer in den Verkehr gebracht werden dürfen, der seinen Sitz im Geltungsbereich des AMG, in einem anderen Mitgliedstaat der Europäischen Union oder in einem anderen Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum hat (§ 9 Abs. 2 Satz 1 AMG). Örtliche Vertreter eines pharmazeutischen Unternehmers können sich nur dann beteiligen, wenn sie selbst pharmazeutischer Unternehmer i. S. d. § 4 Abs. 18 AMG hinsichtlich der jeweils angebotenen Arzneimittel sind.
