What the buyer is looking for
The purpose of this call for tenders is to conclude an insurance contract (‘the contract’) with one participant in order to provide cargo insurance for the transport of military equipment under the CV90 project, carried out between the contracting authority and external suppliers. The subject of the VZ is insurance covering, in particular, the transport of: – separate towers, – complete military vehicles, – or other related components of military equipment. The transports will be carried out as the contracting authority's own transport or through contractual carriers. The insurance must cover transports carried out, as a rule, under the FCA regime, including damage resulting from the loading and unloading of transported goods, including the use of specialised equipment. … out re-shipments in different logistics scenarios, in particular: – transports between suppliers and the contracting authority, – transports for tests (e.g. Bzenec), – transport for handover to the Czech Armed Forces. The number of transports, their exact dates and routes may change during the performance depending on the development of the project and the coordination between the contracting authority and its contractual partners. The contracting authority reserves the right to arrange insurance for individual shipments according to current needs and is not obliged to exhaust the expected scope of performance. Given the nature of the project and the ongoing negotiations between the contracting authority and its partners, it is not possible to determine the exact schedule of shipments or their final scope at the time of awarding the public procurement contract. The insurance must be arranged in such a way as to cover the variability of transports in terms of the time course, scope of performance and type of technology transported. The contracting authority requires a maximum limit per transport of CZK 200,000,000. The required scope of insurance, i.e. places of insurance, scope and subject of insurance, sums insured, deductibles and other insurance requirements, is discussed in more detail in the Technical Part of the ZD and its annexes. The contracting authority restricts the publication of part of the TD for the purpose of protecting sensitive information relating to the transport of military equipment. Annexes Technical parts of the ZD are not freely available on the profile of the contracting authority E-ZAK. The participant or interested party may, via E-ZAK, ask the contracting authority to send a non-public part of the tender documentation. The participant shall send the request for the provision of the non-public part of the TD, including the electronically signed Confidential Information Protection Agreement (NDA), to the contracting authority via the electronic tool E-ZAK via the section ‘Send message’. The contracting authority points out that the function ‘Request for clarification of the TD’ is used exclusively to submit questions about the Tender Specifications and is not intended for sending NDAs or requests for the provision of a non-public part of the TD. NDAs or requests for the provision of a non-public part of the TD received via the ‘Request for clarification of the TD’ function will be considered to have been incorrectly submitted and the contracting authority will not provide a non-public part of the TD on the basis thereof. In accordance with Section 36(8) and Section 96(2) of the Act, the contracting authority reserves the provision of the non-public part of the ZD only subject to the delivery of a proper application and electronically signed by the NDA. The contracting authority/entity shall provide these annexes no later than 3 working days after receipt of the proper request. The contracting authority strongly recommends all interested parties to send a request for access to the non-public part of the ZD before submitting a request to participate. The contracting authority points out that the non-public part of the tender contains information relevant for the preparation of the tender in the second phase of the tender procedure and for the performance of the tender. If a participant does not request its access to the non-public part of the ZD, he/she bears full responsibility for the processing of his/her request to participate and subsequently the tender without knowledge of this information. This will not justify an extension of time limits, amendment of the specifications or any other advantage to the participant during the procurement procedure. For the avoidance of doubt, the contracting authority states that the VZ in question is not a contract for the services of an insurance broker. According to the subject of the Public Procurement Act, the contracting authority does not allow variants of offers pursuant to Section 102(1) of the Act. A participant who submits a tender containing a performance in excess of that required in the TD will be excluded from the further course of the procurement procedure.
