… automation and software logic remain compatible as a whole. The system is based on a manufacturer-managed software logic and software components, and it is not possible to change supplier without a large-scale redesign or replacement of the system with a new system. Arcxo CleanTech Oy, the supplier of the system in use, has announced that it is the only operator that can carry out the automation maintenance and refurbishment work that is the subject of the procurement in order to ensure the technical compatibility and correct operation of the system. The basis for a direct procurement is section 40(2)(2) of the Act on Public Contracts, for technical reasons or reasons related to the protection of exclusive rights, only a specific supplier can carry out the procurement; a further condition is that there are no reasonable alternative or substitute solutions and that the absence of competition is not the result of an artificial narrowing down of the conditions of the procurement.
