For greater certainty, the purpose of the negotiated procedure is to negotiate the requirements, conditions and specifications set out in the procurement documents. However, on the basis of the negotiations, the procurement cannot be substantially different from what is set out in this invitation to participate and its annexes. Negotiations may include, for example, the terms and conditions of the contract and the requirements of the subject of the contract. For greater certainty, as a result of the negotiations, the minimum standards may be increased, but not removed. No compensation shall be paid to candidates for participating in a procurement procedure or preparing a tender. A maximum of 3 candidates will be selected for the negotiated procedure. If there are more than three candidates who meet the suitability requirements, the contracting entity shall select the candidate for participation in the negotiated procedure on the basis of the criteria set out in the reference form annexed to the invitation to participate.
