… points 4(10) and 18 of the maintenance contract. The use of subcontractors is not permitted for the above-mentioned critical tasks. The procurement procedure in question falls under the application of Commission Implementing Regulation (EU) 2025/1197 of 19 June 2025. The contracting authority will therefore provide for the following contractual obligations for the contractor: During the term of the contract, the Contractor shall ensure that the goods or services supplied in performance of the contract and originating in the People's Republic of China do not exceed 50 % of the total value of the contract, whether those goods or services are supplied or provided directly by the Contractor or by a subcontractor. The contractor is obliged to provide the client with suitable evidence to fulfil this obligation at the latest upon handover upon request. In the event of non-compliance, the Contractor shall be required to pay a penalty fee equal to 30% of the total value of the contract, based on the total price as set out in Annex 5 – Price sheet.
