Die Techniker Krankenkasse (nachfolgend TK genannt) beabsichtigt, auszuführende Arbeiten im Bereich "Bodenbelagsarbeiten" im Rahmen eines Rahmenvertrages an einen Auftragnehmer (nachfolgend AN genannt) in folgenden Objekten der TK zu vergeben: - Bramfelder Straße 140 (UZ) und 160 (Erweiterungsbau), 22305 Hamburg, - Habichtstr. 41, 22305 Hamburg, - Museumstr. 33-35, 22765 Hamburg. Der Vertrag beginnt nach der Zuschlagserteilung und endet spätestens nach Ablauf von vier Kalenderjahren, sofern nicht eine der Vertragsparteien mit einer Frist von 3 Monaten zum Ende eines Vertragsjahres kündigt. Innerhalb dieser Rahmenvertragslaufzeit beauftragt die TK den AN im Rahmen von Einzelaufträgen mit der Ausführung von Bodenbelagsarbeiten gemäß den Regelungen und zu den Bedingungen des Rahmenvertrages und seiner Anlagen. Alle im Leistungsverzeichnis (Anlage V2) genannten Mengenangaben stellen sorgfältig ermittelte Planungsannahmen dar, die als Anhaltspunkte für die Kalkulation der Angebote dienen sollen. Eine Abrufverpflichtung der TK in Höhe der angegebenen Mengen besteht jedoch nicht. Maßgeblich sind allein die Einzelabrufe der TK. Der aus der Rahmenvereinbarung abrufbare Gesamtumfang wird auf 110% des Angebotsvergleichspreises des Zuschlagsempfängers festgelegt (Höchstwert).
