Võrdsete hindamistulemuste korral eelistab hankija eduka valimisel pakkujat, kes esitas riigihangete registris pakkumuse kuupäevaliselt ja kella-ajaliselt esimesena. Hankijal on õigus pakkumused tagasi lükata vastavalt RHS § 115 ja § 116 sätetele.
